Richard Epstein: Trump Helps the Environment by Enraging Environmentalists

Professor Richard Epstein wrote and submitted comments on the case for updating the National Environmental Policy Act (NEPA) on behalf of ConservAmerica to the White House Council of Environmental Quality on March 10, 2020. On July 30, he authored a compelling op-ed in the Wall Street Journal.

And as the national discourse on conservation and climate action has only grown louder in recent years, marking Earth Day has perhaps never been more critical.

The White House Council on Environmental Quality recently released a set of provisions to update the National Environmental Policy Act regulations. The proposed updates would streamline the current process for allowing new developments to be built on American soil.

This update to NEPA’s rules, which have remained more or less unchanged for 50 years, is long overdue. And it’s a change that business leaders and environmentalists alike should embrace.

ConservAmerica Public Comments on Proposed NEPA Regulations

ConservAmerica today submitted written comments on the White House Council on Environmental Quality (CEQ) proposed revisions to the regulations implementing the National Environmental Policy Act (NEPA).

It has been more than 40 years since CEQ’s rules implementing NEPA have been revised. In that time, the NEPA environmental review and permitting process has become increasingly complex and time-consuming. It now extends far beyond what Congress originally intended – which was a procedural statute requiring federal agencies to assess the environmental, social, and economic impacts of proposed major federal actions.
